Terms of Use (EULA) for JustSell.it

1. Agreement to Terms

By downloading, installing, or using the JustSell.it mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

JustSell.it is a mobile application that allows you to:

• Take or select photos of items you want to sell
• Generate AI-powered listing descriptions, titles, categories, and suggested prices
• Copy and use the generated listings on selling platforms of your choice (for example OLX, Allegro, Facebook Marketplace)

The App does not publish listings directly to any platform. It generates content that you can copy and use at your discretion.

3. Credits and Purchases

3.1. Free Credits

• Upon creating an account, you receive a one-time grant of free credits
• The number of free credits is determined at our sole discretion and may change at any time without notice
• Free credits are non-transferable
• We reserve the right to modify, reduce, or revoke free credits at any time without prior notice or compensation
• Free credits may be removed from accounts that have been inactive for 12 consecutive months or more

3.2. Credit Packs

• Additional credits can be purchased as one-time in-app purchases (not subscriptions)
• Available packs and their sizes are displayed in the App at the time of purchase
• Prices are displayed in the App at the time of purchase and may vary by region
• Purchased credits are valid for 100 days from the date of purchase. Unused credits expire after this period and are not refundable

3.3. Credit Usage

• Each listing generation consumes 1 credit
• Credits are non-refundable once used
• Credits are tied to your account and cannot be transferred

3.4. Purchase Processing

• In-app purchases are processed by Apple App Store or Google Play Store
• Refund requests should be directed to Apple or Google according to their refund policies
• The credit validity period (100 days) and all purchase terms are displayed in the App prior to completing a purchase

3.5. Right of Withdrawal (EU)

• In accordance with EU consumer protection law, you have a 14-day right of withdrawal from digital purchases
• By completing a credit purchase and consenting to immediate delivery of digital content, you expressly acknowledge and agree that you waive your right of withdrawal once credits are delivered to your account
• This waiver is presented and requires your consent during the purchase flow

4. AI-Generated Content

4.1. Nature of Content

• Listing descriptions, titles, categories, and prices are generated by artificial intelligence
• AI-generated content is provided as suggestions and may not be fully accurate
• You are responsible for reviewing and editing generated content before publishing

4.2. No Guarantees

• We do not guarantee the accuracy of suggested prices or categories
• We do not guarantee that generated descriptions will result in successful sales
• Generated content may require editing to meet specific platform requirements

4.3. Content Ownership

• You own the rights to any listing content generated for you through the App
• You are free to use, modify, and publish generated content on any platform

5. User Responsibilities

You agree to:

• Use the App only for lawful purposes
• Not use the App to create listings for illegal, prohibited, or restricted items
• Review and verify all AI-generated content before publishing
• Comply with the terms of service of any platform where you publish listings
• Maintain the security of your account credentials
• Not attempt to reverse engineer, decompile, or disassemble the App
• Not exploit bugs or vulnerabilities to gain credits or features without payment

6. Account and Authentication

• You must sign in using Google Sign-In or Apple Sign-In to use the App
• You are responsible for maintaining the confidentiality of your account
• You must not share your account with others or create multiple accounts
• We reserve the right to suspend or terminate accounts that violate these Terms

7. Privacy

Your use of the App is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your information.

8. Intellectual Property

All content, features, functionality, and branding of the App (excluding user-generated listings) are owned by JustSell.it and are protected by international copyright, trademark, and other intellectual property laws.

9. Limitation of Liability

To the maximum extent permitted by law:

• JustSell.it shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App
• JustSell.it is not responsible for the accuracy of AI-generated content, including suggested prices
• JustSell.it is not responsible for any losses resulting from the use of generated listings on third-party platforms
• JustSell.it is not a party to any transaction between you and buyers of your items

10. Service Availability

• We reserve the right to modify, suspend, or discontinue the App or any part thereof at any time without notice
• We do not guarantee uninterrupted access to the AI processing service
• In the event of service disruption, unused credits will remain valid for future use, subject to their applicable expiration period

11. Force Majeure

JustSell.it shall not be liable for any failure or delay in performing its obligations (including but not limited to service availability and credit expiration timelines) caused by circumstances beyond its reasonable control, including but not limited to: natural disasters, acts of government, internet or infrastructure outages, third-party service failures (including AI providers, cloud hosting, and app store platforms), cyberattacks, pandemics, or other force majeure events. Credit expiration periods continue to run during such events and are not extended.

12. Prohibited Uses

You may not use the App to:

• Create listings for illegal, counterfeit, stolen, or prohibited items
• Generate misleading or fraudulent descriptions
• Harass, abuse, or harm others
• Circumvent credit limits or payment systems
• Overload or interfere with the App's servers or infrastructure

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by:

• Posting the updated Terms in the App with a revised "Last Updated" date
• Displaying a prominent in-app notice upon the first launch after the update

For material changes (including changes to credit pricing, validity periods, or user rights), we will provide at least 14 days' notice before the changes take effect. Your continued use of the App after the effective date of such changes constitutes acceptance of the new Terms. If you do not agree with the updated Terms, you must stop using the App.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Poland.

16. Apple-Specific Terms

If you are using the App on an iOS device:

• These Terms are between you and JustSell.it, not Apple
• Apple is not responsible for the App or its content
• Your use of the App must comply with Apple's App Store Terms of Service
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you
• Apple has no obligation to furnish any maintenance or support services for the App

17. Google Play-Specific Terms

If you are using the App on an Android device:

• These Terms are between you and JustSell.it, not Google
• Google is not responsible for the App or its content
• Your use of the App must comply with Google Play Terms of Service

By using JustSell.it, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use.
